Scoring a $20 Million Jury Verdict
Won a $20 million jury verdict for a global manufacturer of medical devices in the District of Delaware. The jury found that the defendant directly infringed a patent and willfully induced its manufacturer to infringe a second patent directed to spinal cord stimulation technology. This was the first trial in a series of disputes between the parties, which includes district court patent and trade secret litigations, as well as inter partes review (IPR) proceedings before the U.S. Patent & Trademark Office (USPTO) and related appeals before the Federal Circuit.
High-Stakes Litigation
Defeated a motion for class certification in a significant action filed on behalf of the California customers of a multinational telecommunications and media conglomerate. Challenged the broadcast tv and regional sports fees as deceptive and unfair, and sought classwide damages estimated at over $1 billion for the seven-year proposed class period.

In an important victory on behalf of a prominent public company, the 11th Circuit reversed a district court decision denying a motion to compel arbitration, adopting our argument that the case must be arbitrated because the plaintiff’s claim at least “relates to” his prior Subscriber Agreement. Plaintiff in the case argued that the arbitration clause is a so-called “infinite” arbitration clause, the enforceability of which is an issue of first impression currently percolating through various circuits.
Cross-Practice Victory
A joint appellate and IP team secured a major cross-practice victory in the federal circuit for our client, a leading pharmaceutical company. The victory in this closely watched case not only fends off an IPR challenge to a patent associated with its multibillion-dollar schizophrenia treatment, but also settles a hotly contested question in the IP world regarding the appealability of Patent Trial and Appeal Board (PTAB) decisions denying institution.
Big Win at the PTAB
Secured a critical victory at the PTAB, which denied institution of an IPR petition brought by a health care corporation against a pharmaceutical company. The patent under review covers a method of using a multibillion-dollar product for the treatment of schizophrenia. The pharmaceutical company has asserted the patent against generic manufacturers in two separate Abbreviated New Drug Application (ANDA) litigations in New Jersey. The two companies are seeking approval for generic versions of the drug.
A Matter with Lasting Implications
Scoring a critical victory for a major telecommunications company with far-reaching impact throughout the industry nationwide, Akin defeated a motion to certify a class in a matter that brought into question violations of California’s consumer protection statutes in relation to its advertisements.
